Open only to legal residents of the 50 contiguous United States and the District of Columbia, who are 18 years of age and older as of 7/14/2008. Employees of Olympus Imaging America Inc. (Herein referred to as Sponsor), the United States Tennis Association Incorporated, their parents, affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible and should not enter this contest. Void elsewhere and where prohibited by law

  1. PROMOTION TIMING: Contesting begins at 12:00:01 a.m. ET on 7/14/2008 and ends at 11:59:59 p.m. ET on 9/07/2008 (“Promotion Period”).
  2. HOW TO ENTER: Visit the Capture the Action display at the Olympus US Open Series or US Open Promotional Booth located at the following Event locations: Bank of the West Tennis Tournament 7/14-7/20, Indianapolis Tennis Championship 7/14 – 7/20, East West Bank Classic 7/21 – 7/27, Western and Southern Financial Group tennis tournament 7/28-8/3, Countrywide Classic 8/4 – 8/10 , Legg Mason Tennis Championship 8/11 – 8/17, Pilot Pen Tennis Championship 08/18 – 8/23, US Open Tennis Championship 08/25 – 09/07). Complete all of the required entry information and participate in the photo competition.

    OLYMPUS AMERICA, INC. WAIVER AND RELEASE:

    By participating in this contest, participant agrees that all photographs and associated intellectual property (including, without limitation, copyrights and trademarks related thereto) are automatically transferred to Olympus (as hereinafter defined) which shall have sole and exclusive ownership of the same. By accepting a prize, each winner agrees that Olympus may use the winner’s name, picture/portrait, physical likeness and/or voice for advertising, promotional and other purposes without further consideration, unless prohibited by law. Olympus may use such photographs and each winner’s name, picture/portrait/physical likeness and/or voice for any and all purposes.

    FOR GOOD AND ADEQUATE CONSIDERATION, receipt of which is hereby acknowledged, the undersigned and his/her successors, agents, heirs and assigns (collectively, the “undersigned”), does hereby forever waive, release and discharge and hold harmless Olympus America Inc., United States Tennis Association Incorporated, USTA National Tennis Center Incorporated, the City of New York, the respective Olympus US Open Series tournaments and their parent, subsidiaries, and affiliated corporations, and each of their respective officers, directors, employees, agents, successors, and assigns (collectively, "Releasees"), from any and all claims, debts, damages, judgments, liabilities, demands, obligations, sums of money, costs, expenses, disputes, suits, controversies, actions, and causes of action of every nature and every kind, whether known or unknown, fixed or contingent, in law, admiralty, or equity, which the undersigned may at any time own or hold against Releasees for any and all reasons (including, without limitation, any acts, omissions, circumstances, facts, events, or transactions) relating to any portion or aspect of the undersigned being a contestant in this Olympus Capture The Action Photo Contest.

    You may only enter this contest by filling out the required form and participating in the photo competition portion, entrants may participate once per day during the contest period. One Winner Per Household. Entries must be received by 11:59:59 p.m. ET on the final day of each event to be eligible. Photo Entries must be received by 11:59:59 p.m. ET on 9/07/2008 to be eligible for the final Event Drawing. Use of computer programs and other automatic means to enter the Capture The Action contest is prohibited.

  3. DRAWINGS: One daily winner will be selected from among all eligible entries received each day the Capture The Action contest is active. Daily winners receive an Olympus Stylus 850 SW camera. Daily winners are selected by Olympus photo judges based on the following criteria: Originality, Photographic Quality, Composition, and Event Theme. (US retail value for the Stylus 850 SW $299.99.) Decisions of judges are final. Daily drawing will be conducted by the Sponsor, whose decisions are final on all matters relating to the Capture The Action contest. Odds of winning are dependent upon the number of eligible entries received. All prizes will be awarded and winners will be notified by email or mail.
  4. ADVANCEMENT:Daily winners of the Capture The Action contest will advance to the on line photo portion whereas visitors to www.olympususopenseries.com and www.usopenseries.com will select “best” photos from all entries displayed. Entry photos are provided by Olympus based on daily winners collected from the following events: Bank of the West Tennis Tournament 7/14-7/20, Indianapolis Tennis Championship 7/14 – 7/20, East West Bank Classic 7/21 – 7/27, Western and Southern Financial Group tennis tournament 7/28-8/3, Countrywide Classic 8/4 – 8/10 , Legg Mason Tennis Championship 8/11 – 8/17, Pilot Pen Tennis Championship 08/18 – 8/23, US Open Tennis Championship 08/25 – 09/07. Photo entries deemed to be the best based on the number of votes attained during each voting period are eligible to advance for a chance to win the Grand Prize of an Olympus EVOLT E520 digital SLR camera valued at $999.99. The photo entry garnering the highest percentage of votes during the on line voting period will be awarded the grand prize. Grand Prize winner will be notified via registered mail. All federal, state, provincial, municipal and local taxes are the sole responsibility of winner, if applicable.
  5. PRIZES, APPROXIMATE RETAIL VALUE: (US retail values for the Stylus 850 SW and the EVOLT E520 digital SLR camera are $299.99 and $999.99 respectively)
  6. ELIGIBILITY: Open to legal residents of the contiguous 50 United States and the District of Columbia. Employees of Olympus Imaging America Inc., the United States Tennis Association, their parents, affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible. Void elsewhere and where prohibited or restricted by law. All federal, state, municipal and local laws and regulations apply.
  7. GENERAL RULES: No substitution or transfer of prize permitted except at the sole discretion of the Sponsor who reserves the right to substitute a prize of equal or greater value in the event the prize is unavailable. All federal, state, municipal and local taxes are the sole responsibility of winner, if applicable. Return of any prize/prize notification may result in disqualification and alternate selection. If any prize or prize notification is returned as non-deliverable, the potential winner will be disqualified and an alternate winner will be selected. By participating in this promotion, entrants agree to be bound by the official rules and the decisions of the judges. By accepting the prize, winners agree that the Sponsor and those acting under the Sponsor's authority, may use winner's name, picture/portrait likeness and/or voice, for advertising and promotional purposes without further consideration, unless prohibited by law. Entrants agree to be bound by these Official Rules and the decisions of the judges. By accepting prize, winner agrees that the Sponsor, its respective subsidiaries, affiliates, advertising and promotion agencies, and their directors, employees, representatives and agents, will have no liability whatsoever for, and will be held harmless by winner for any liability for any injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of the prize or participation in this sweepstakes or any prize related activity. All entries become the sole property of Sponsor and none will be returned.

    The potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the contest, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest and award those Daily prizes from among all eligible entries received for each day prior to cancellation or termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
