US OPEN SERIES PICK ’EM GAME

OFFICIAL RULES

NO PAYMENT, ENTRY FEE OR PURCHASE REQUIRED. 

HOW TO ENTER:  Enter the Us Open Series Pick ’Em Game (“Pick ’Em” or the “Game”)  online at http://pickem.usta.com by filling out the online entry form. Each contestant will create an online Username and Password.  Pick ’Em begins July 25, 2005 and ends August 28, 2005 (the “Contest Period”).  Contestants are not required to enter every day of the Contest Period, but doing so will increase your chance of winning the Grand Prize.  Entries for any day’s Selected Matches (as defined below) must be received online between approximately 4 pm (EDT) on the preceding day and 11 am (EDT) on the day of such selected matches.  Limit one entry per person per day. 

ELIGIBILITY AND PARTICIPATION:  Sweepstakes open only to legal residents of the United States who are eighteen (18) years of age or older at the time of entry.  Employees (and their immediate families -- meaning spouses, parents, siblings, children and their respective spouses) of the United States Tennis Association Incorporated (the “USTA”) (, the US Open Series Tournaments, their respective affiliates, promotion and advertising agencies and anyone involved in the Sweepstakes’ development or execution are not eligible to participate in the Game.  Contestants must have Internet access as of July 23, 2005.  By taking part in this Sweepstakes, participants agree to be bound by these Official Rules.  Sponsor reserves the right to permanently disqualify from this Sweepstakes any person it believes has intentionally violated these Official Rules.  Sweepstakes subject to all Federal, state and local laws. VOID WHERE PROHIBITED. 

VALIDATIONS:  Sweepstakes materials are void if they contain printing, mechanical or other errors.  Incomplete entries will be disqualified.  No responsibility will be assumed for lost, late, illegible, incomplete or misdirected entries.  Sponsor and its agencies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software transmissions or technical failures, incomplete, delayed or garbled transmissions or other errors or problems of any kind, whether mechanical, electronic, human or otherwise.  Sponsor reserves the right, in their sole discretion, to cancel or suspend this Sweepstakes should a virus, bug, computer or other problem beyond Sponsors’ control corrupt the administration, security or proper play of this Sweepstakes.  Sponsor reserve the right to award prizes from among all eligible entries received prior to the date of suspension.  If Sponsor determines that there is any suspected or actual electronic tampering with the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right, in their sole discretion, to void any entries that appear to have been submitted fraudulently or to cancel or modify the Sweepstakes, in whole or in part.  All entries become property of Sponsor and none will be acknowledged or returned.   In the event of any dispute regarding the identity of a person submitting an entry, the entry will be deemed submitted by the authorized e-mail account holder, which is defined for these Official Rules as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

PICK ’EM GAME RULES:  Contestants win points by correctly picking the winning player after the actual match score is adjusted with “The Line” (see Example Match that follows).  There will be a limited number of matches selected by Sponsor each day during select 2005 US Open Series Tournaments (“Selected Matches”) (generally five (5) Selected Matches per day, but during the closing days of each tournament there will be fewer Selected Matches).  Contestants pick the player they believe will win the Selected Match once the actual match score is adjusted with “The Line” for each day’s Selected Matches by visiting http://pickem.usta.com and logging in using their chosen Username and Password. The entry period for each day’s Selected Matches begins at approximately 4 pm (EDT) the night prior to the day the Selected Matches are scheduled to take place and ends at 11 am (EDT) on the scheduled day of the Selected Matches.  Each correct pick of a player that is “giving points” (the “favored player”) earns one (1) point.  Each correct pick of a player that is “getting points” (the “underdog”) earns two (2) points.  All Pick ’Em results and match lines will be managed by the Sponsor.  At the end of each week (beginning with the week of July 25, 2005 through the week of August 22, 2005), which shall start on Monday and end on Sunday (the “Week”), the Pick ’Em contestant for that Week with the highest point total wins a First Prize.  If one or more contestants tie for any given Week, the winner will be determined by random drawing.  At the end of the Contest Period, the Pick ‘Em contestant for the Contest Period with the highest point total wins the Grand Prize.  If one or more contestants tie for the Grand Prize one winner will be determined by random drawing.
 
Example Selected Match: In each Selected Match, Player A will be the player favored to win the match.  After Player B, there will be a number value in brackets.  For example, Player A vs. Player B [ 7].  This parenthetical number represents “The Line”, meaning the number of total games Player A will be “giving” Player B.  The number of games that are being “given” to Player B (7) will be added to the number of games Player B actually wins in the Selected Match.

Example Selected Match Result: Player A wins the Selected Match 6-3, 6-3.  In this example Selected Match, Player A won 12 total games, while Player B won 6.  Using “The Line”, the scores are adjusted, so that Player B wins this  Pick ’Em match-up by the score of 13 games (the 6 games actually won plus the 7 games given in “The Line”) to 12.  Therefore, if contestant picked Player B to win the Selected Match, contestant earns two (2) points.

Among the five Selected Matches for each day (subject to the round of the applicable Tournament), there will be one (1) featured “Match of the Day” every day during the Contest Period.  By correctly selecting the winning player of this Selected Match, the Pick ’Em contestants can earn extra points. Each correct Match of the Day pick of a player that is “giving points” (the favored player) earns two (2) points.  Each correct pick of a player that is “getting points” (the underdog) earns four (4) points.

In the event of a tie in any Selected Match no points shall be awarded for that Selected Match.  For example, using 7 as “The Line,” if Player A wins the Selected Match 6-2, 6-3.  In this example, Player A won 12 total games, while Player B won 5 total games.  Using “The Line”, the scores are adjusted, so that the Players tie this Pick ’Em Selected Match with a score of 12 games each.  Therefore, no points are awarded.

  In the event of a postponement (due to rain or other extenuating circumstances), the rescheduled Selected Matches will count on the actual day they are played in addition to Selected Matches for that day.  Any game played before the delay will count towards the day the completed Selected Match is finished.  If all of a day’s Selected Matches are completely postponed for any reason, there will be no points awarded for that day.  However, if any of the Selected Matches on a given day are completed there will be points awarded as set forth herein.  If any player retires or does not complete a Selected Match, for any reason, there will be no points awarded for that Selected Match.

Winners will be notified by phone and/or e-mail on or about September 20, 2005.  Grand Prize Winner and one (1) Grand Prize Winner guest (“GPW Guest”), and parent or guardian of Grand Prize Winner and/or GPW Guest who is under the age of majority in his/her state of residence, will be required to sign and return to Sponsor an affidavit of eligibility and liability and publicity release (unless prohibited by law) within 10 days of notification.  If a winner cannot be reached within five (5) days after notification, or if documents are not returned timely, or if prize or prize notification is returned as non-deliverable, or in the event of non-compliance with any of these requirements, that prize will be forfeited, and an alternate winner will be selected at random from among the remaining eligible entries. 

PRIZES:  One (1) Grand Prize:  Two (2) tickets to the 2006 US Open, one (1) US Open hat and one (1) US Open t-shirt.  Date of tickets subject to USTA availability.  ARV of Grand Prize: $290.  All expenses not specified in these Official Rules, including, without limitation, lodging, taxes, insurance, meals, gratuities, spending money, phone calls and transportation (ground and/or air) costs, are winner’s responsibility.

Five (5) First Prizes:  Each First Prize consists of a one (1) 2005 US Open hat and one (1) 2005 US Open t-shirt that will be distributed on or about September 20, 2005.  ARV of each First Prize: $40.

Total ARV of all Prizes:  $490.00.

Prizes may not be substituted, transferred or redeemed for cash, except by Sponsor, who reserves the right to substitute the prize (or any single component of the prize package) with a prize of equal or greater value in its sole discretion.  Odds of winning depend on the number of eligible entries received.

GENERAL CONDITIONS:  By participating in this Sweepstakes, entrants, winners, and any guests of winners release USTA, USTA National Tennis Center Incorporated and the City of New York and their respective affiliates, subsidiaries, parent companies, shareholders, advertising and promotion agencies, officers, directors, employees, representatives, agents and all others associated with the development or execution of this Sweepstakes, from any and all liability in any way arising from this Sweepstakes and/or the receipt, use or misuse of a prize or parts thereof, including, without limitation, liability for death, personal injury, damage or loss of any kind, and from liability to any other persons relating to or resulting from entering or downloading materials or software in connection with these Sweepstakes.  Entry constitutes permission (except where prohibited by law) to use a winner’s name and hometown on Sponsor’s websites and to use a winner’s name, city, state, likeness and/or voice for purposes of advertising, promotion and publicity without additional compensation in perpetuity.

MISCELLANEOUS:  Participants agree that this Sweepstakes is governed solely by United States law.  Any claims arising out of the Sweepstakes shall be governed solely by United States law and may be brought only in a Federal or state court in Westchester County, New York.  If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
