This sweepstakes is intended for play in the 48 contiguous United States (excluding Alaska and Hawaii) and District of Columbia only and shall be construed and evaluated according to United States law. Do not enter this sweepstakes if you are not a legal resident of and located in the 48 contiguous United States or the District of Columbia at the time of entry. This sweepstakes is open only to legal residents of the 48 contiguous United States and the District of Columbia who are 18 years of age or older. Void outside the 48 contiguous United States, the District of Columbia and where prohibited. Sweepstakes begins at 12:01:00 a.m. ET on July 11, 2008 and ends at 11:59:59 p.m. ET on August 17, 2008 (provided, however, online entries will only be accepted between July 22, 2008 at 12:01:00 a.m. ET through August 17, 2008 at 11:59:59 p.m. ET).
HOW TO ENTER. You may enter the Olympus US Open Series Greatest Road Trip in Sports Sweepstakes (the "Sweepstakes") in any of the following three ways:
(1) by text messaging from you mobile phone or by mail. To enter by text messaging from your mobile phone, text “TENNIS” to 36617 and you will automatically be entered into the Sweepstakes. Text messaging method of entry requires 2-way text messaging capable mobile phone and digital service. When entering by text messaging, you will be charged for the message that originated from your mobile phone according to the terms in your calling plan with your carrier. Text messaging is not available in all areas of the United States.
(2) by mail, simply hand print your name and address (including zip code), home and mobile phone number (including area codes), email address and date of birth on a 3”x5” postcard and mail to: US Open Series Greatest Road Trip in Sports Sweepstakes, C/O emg3, 215 Commercial Street, 2nd Floor, Portland, ME 04101. No purchase necessary to enter by mail. All text message entries must be received by 11:59:59pm ET on August 17, 2008 to be eligible. All mail-in entries must be postmarked by August 11, 2008 and received on or before August 17, 2008.
(3) online, between July 22, 2008 at 12:01:00 a.m. ET through August 17, 2008 at 11:59:59 p.m. ET, log on to www.usopenseries.com/roadtripsweepstakes, complete the entry form in its entirety, and follow the onscreen directions to submit.
You may enter as often as you wish, regardless of method of entry, however, each mail entry must be hand printed and mailed in a separate, hand addressed envelope. In case of dispute as to the identity of a text message entrant, entry will be declared made by the authorized account holder of the mobile telephone number. “Authorized Account Holder” for the purpose of text messaging is defined as the natural person who is assigned a mobile telephone number by the wireless carrier or as shown on the carrier’s records. The Authorized Account Holder may be required to provide proof of identity. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the e-mail address provided at time of entry. Authorized Account Holder for the purpose of online entries is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries become the sole property of the United States Tennis Association Incorporated (“USTA” or “Sponsor”) and will not be acknowledged or returned. Any other attempted form of entry is prohibited; no automatic, programmed, robotic, or similar means of entry are permitted.
ELIGIBILITY. The Sweepstakes is open only to legal residents of the 48 contiguous United States and the District of Columbia, who are 18 years of age or older. Employees of USTA and its respective subsidiaries, affiliates, parent companies, sales representatives, agents, advertising and promotion agencies or any other agencies or entities involved with this Sweepstakes and members of their respective families (parents, siblings, children, and spouse and their respective spouses) and/or those residing in the same household (whether related or not) of each of the above are not eligible to enter or win. By participating in this Sweepstakes, participants agree to be bound by these Official Rules. USTA reserves the right to disqualify from this Sweepstakes any person it believes has intentionally violated these Rules.
DRAWING; ODDS. Winner will be selected in a random drawing from all eligible entries received on or about August 18, 2008. Drawing will be random and conducted by emg3. Odds of winning depend upon the total number of eligible entries received.
PRIZE. One (1) Grand Prize will be awarded consisting of a trip for two (2) to the 2008 US Open Tennis Championships in Flushing Meadows, New York. Trip consists of round-trip coach air transportation for winner and one (1) guest from the major commercial airport nearest to the winner’s residence (airport to be chosen by the USTA in its sole discretion) to New York City, New York, two (2) nights hotel accommodations (one room, double occupancy), ground transportation between the New York airport and the hotel, ground transportation between the hotel and the US Open, two (2) tickets to a designated session of the 2008 US Open (session and seat location as determined by Sponsor in its sole discretion), $500 spending money, and a special US Open gift basket which will include official US Open apparel. The Grand Prize winner is solely responsible for all other expenses not specifically set forth herein, including but not limited to gratuities, travel upgrades, incidentals and other ground transportation. Approximate retail value of Grand Prize: $3,250 depending on airfare fluctuations and point of origin.
TERMS AND CONDITIONS. Potential winner will be notified by overnight mail on or about August 18, 2008 and will be required to sign and return an Affidavit of Eligibility and a Liability and Publicity Release (where permissible) within two (2) days of notification. If prize/prize notification is returned as undeliverable or if winner is unable to confirm the ability to use the prize by August 21, 2008, such prize will be forfeited and an alternate winner will be selected. Winner’s travel companion must also sign a Liability Release and a Publicity Release prior to ticketing of prize. Any traveler under 18 years old must be accompanied by a parent or legal guardian during all aspects of the Grand Prize trip at his or her own expense, unless such parent or legal guardian is the selected winner. Such parent or legal guardian must sign and return all required documentation. Winner and guest must travel together on the same itinerary. In the event of non-compliance with any of these requirements, prize may be forfeited and awarded to an alternate winner. Upon verification of eligibility, prize winner will be notified by e-mail, mail and/or phone regarding the details of the prize. By accepting the prize, the winner agrees to accept the prize in the manner set forth by the USTA. The winner is responsible for all applicable federal, state, and local taxes on prize. The prize winner will be issued a Form 1099, for income verification and tax purposes, for the retail value of the prize. The winner is advised to seek independent counsel regarding the tax implications of their respective prize winnings. The Grand Prize trip must be taken on the following dates: Departure on September 5, 2008 and Return on September 7, 2008. If the potential Grand Prize winner is unable to take the trip during this time, such winner will be disqualified and an alternate Grand Prize winner will be selected from the remaining eligible entries, provided sufficient time remains prior to US Open. USTA is not responsible if US Open designated session is rained out or postponed, or cancelled after ticketing of prize for any reason, in whole or in part. In that event, winner will receive remainder of the prize and the ticket portion of the prize is forfeited. No compensation will be paid in lieu of US Open ticket portion of prize. USTA reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. Grand Prize is not transferable, assignable or redeemable for cash. By participating, entrants agree to be bound by these Official Rules, which shall be final and binding in all respects. By accepting Grand Prize, winner releases and holds harmless United States Tennis Association Incorporated, USTA National Tennis Center Incorporated, the City of New York, Hip Cricket and their respective parent companies, subsidiaries, affiliates, dealers, and the directors, officers, employees or agents of any of the above organizations (the “Releasees”) from any and all liability and will be held harmless by winner and his/her heirs and executors for any injury including personal injury, death, loss or damages of any kind, arising from participation in or in connection with acceptance, possession, use, misuse and/or nonuse of any prize or participation and/or traveling to any prize-related activities, or any claims based on right of publicity/right of privacy. By entering this Sweepstakes, you hereby grant permission for Sponsor to collect personal information from you. The Releasees do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability and fitness for a particular purpose. By accepting prize, winner understands and assumes the risks of air travel and attendance at public events. The Releasees accept no responsibility for any additional expenses, omissions, delays, re-routing or acts of any government or authority. USTA reserves the right to modify this Sweepstakes in any way it deems necessary or appropriate. Except where prohibited, by accepting prize, the winner grants USTA the right to use and publish his/her photograph, likeness, name, city and state of residence and/or likeness for advertising and promotional purposes in any media in connection with the Sweepstakes without limitation and without additional compensation.
OTHER. USTA, its affiliates, partners and promotion and advertising agencies are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections or mail, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer or telephone transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s mobile telephone or computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes. USTA and its agencies are not responsible for lost, late, stolen, illegible, incomplete, misdirected, damaged or destroyed entries or for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including, without limitation, the incorrect or inaccurate capture of entry information online or incorrect or inaccurate mailed entries. Once submitted, entries become the exclusive property of USTA and will not be returned. Entry material/data that has been tampered with or altered is void. If for any reason, (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of USTA), the administration, security, fairness, integrity, or proper conduct of the Sweepstakes is corrupted or affected such that this Sweepstakes is not capable of being conducted as described in these Official Rules, USTA shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes or to select a winner for any remaining prizes by randomly drawing from among all valid entries received, up to such time of cancellation, termination, or suspension, and/or solely from the mailed entries. ANY ATTEMPT BY ANY PERSON TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, USTA RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

MISCELLANEOUS. Participants agree that this Sweepstakes is governed solely by the laws of the United States and any claims arising out of this Sweepstakes may be brought only in a federal or state court located in the counties of New York or Westchester, New York. If any provisions of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
